1. General Provisions
1.1. These Terms & Conditions apply to all legal relationships arising from the purchase of products via the JahiKala.ee online store (hereinafter “JahiKala”) between any customer and the owner of the online store, JahiKala OÜ.
1.2. In addition to these Terms & Conditions, all legal relationships arising from purchases made via the JahiKala online store are governed by the laws in force in the Republic of Estonia.
1.3. JahiKala OÜ is entitled to amend and supplement these Terms & Conditions and the price list to ensure better and safer use of the online store. JahiKala OÜ reserves the right to make changes to the sales terms and price list, which will be published on the website www.jahikala.ee. If an order is placed before a price change takes effect, the terms in force at the time of placing the order shall apply.
1.4. A sales contract is deemed concluded (contract enters into force) from the moment the amount payable according to the order confirmation is received in the bank account of JahiKala OÜ.
2. Order Cancellation and Right of Withdrawal
2.1. The Buyer may cancel their order after payment but before the goods are delivered by sending a cancellation request to epood@jahikala.ee, including the order number and bank account number.
2.2. After receiving the goods, the Buyer has 14 days to inspect the products. If the purchased goods do not suit the Buyer for any reason, the Buyer may return or exchange the goods within 14 days by sending a withdrawal notice to epood@jahikala.ee, including the order number.
2.3. In the event of cancelling an order under clause 2.1 or withdrawing under clause 2.2, the paid amount shall be refunded, from which the Buyer shall bear the costs related to returning the goods to the warehouse. Processing return requests may take up to 30 days; however, the refund will be made within the timeframe required by law.
2.4. Returned goods must be in their original packaging, unused, and include all original items that were included in the package. If the product was purchased as part of a promotion together with additional items, the entire set must be returned, including all additional items.
2.5. If the returned product or its packaging is damaged due to improper use and the damage is not caused by JahiKala OÜ, the Seller has the right to reduce the refundable amount to the extent of the decrease in value of the goods. Information regarding set-off will be sent to the Buyer by e-mail. If the Buyer does not agree with the assessment of the decrease in value, an independent expert may be engaged. The costs of the expert assessment shall be shared equally, except where the expert opinion shows that one party’s position was clearly unfounded, in which case that party shall bear the costs.
The refundable amount may be reduced by up to 30% if the product/packaging is not in its original, complete, and resaleable condition.
2.6. The product may only be handled and tested in the same manner as would be possible in a physical shop. If the product has been used beyond what is necessary for inspection, the refundable amount may be reduced according to the decrease in value.
3. Product Exchange
3.1. If the product does not suit the Buyer, the Buyer may exchange it for another product, provided the desired product is available in stock. All costs related to the exchange shall be borne by the Buyer.
4. Liability and Force Majeure
4.1. JahiKala OÜ is liable to the Buyer, and the Buyer is liable to JahiKala OÜ, for damage caused to the other party by breach of these Terms & Conditions, in the cases and to the extent provided by the laws of the Republic of Estonia.
4.2. JahiKala OÜ shall not be liable for damage resulting from circumstances beyond its reasonable control (force majeure), including natural disasters, strikes, transport delays, or other unforeseen obstacles.
5. Processing of Personal Data
5.1. JahiKala processes all personal data provided by the Buyer strictly confidentially and uses it only for order fulfilment and customer service purposes. Where necessary, personal data may also be shared with logistics partners in order to arrange delivery.
5.2. JahiKala OÜ endeavours to implement all possible technical and organisational measures to prevent loss, misuse, or alteration of the Buyer’s personal information. Encrypted data transmission channels with banks ensure the security of the Buyer’s personal data and banking details.
6. Dispute Resolution
6.1. Any disputes shall be resolved through negotiations. If no agreement is reached, the Buyer has the right to contact the Consumer Protection and Technical Regulatory Authority of Estonia.
6.2. JahiKala OÜ follows the laws of the Republic of Estonia when resolving disputes.
7. Payment
7.1. The Buyer may choose from various payment methods, including bank transfers (Swedbank, SEB, LHV), credit cards, PayPal, and Apple Pay. Payments are processed in a secure environment where data is transmitted in encrypted form. After payment, the Buyer will receive an order confirmation by e-mail.
8. Shipping and Delivery
8.1. The delivery fee is calculated based on the selected shipping method and is displayed at checkout and on the invoice. If the order needs to be delivered to multiple different addresses, a separate order must be placed for each address.
8.2. JahiKala OÜ reserves the right to adjust shipping fees and product prices in its online store without prior notice.
8.3. Delivery within Estonia generally takes 1–3 business days, depending on order processing and destination. Delivery time for items ordered from suppliers/central warehouse may be longer (up to 3–15 business days). Delivery is carried out via Omniva, DPD and SmartPost parcel machines and courier services. Additional costs may apply for oversized or heavier items, and the Buyer will be informed separately.
8.4. If the free shipping threshold is no longer met due to a partial return, the Seller has the right to deduct the original delivery cost from the refundable amount.
9. Warranty and Submitting Claims
9.1. Warranty Coverage
JahiKala OÜ sells products that are covered by warranty under the terms specified by the manufacturer. The warranty period is generally 1 year from the date of purchase, ensuring the quality of materials and workmanship. The warranty does not cover normal wear and tear, misuse, accidents, or defects caused by improper use.
9.2. Warranty Terms
The warranty covers defects caused by manufacturing faults or material defects under normal conditions of use. For example, fishing rods and reels are covered by a one-year warranty from the purchase date, provided a valid proof of purchase is presented. All repair or replacement costs, including return and shipping costs, are borne by the Buyer unless the issue qualifies as a warranty case.
9.3. Warranty Exclusions
The warranty does not cover damage caused by misuse (e.g., fishing conditions such as snagging, high pressure, or improper handling). Fishing rods and other equipment used for unintended purposes or with aggressive techniques are not covered by the warranty.
9.4. Claim Procedure
If a defect occurs, the Buyer must submit a warranty claim by e-mail to epood@jahikala.ee and attach a copy of the proof of purchase. The defective product must be returned in proper packaging to prevent additional damage during transportation. Under warranty, JahiKala OÜ will repair or replace the product as necessary.
9.5. Extended Warranty in Exceptional Cases
For certain higher-priced products, such as more complex fishing electronics or hunting equipment, an extended warranty of up to 2 or 3 years may apply. The exact warranty terms and period are stated on the relevant product page.
